Who is the Ameerul Mu’mineen (Commander of the Faithful) today?

Who is the Ameerul Mu’mineen (Commander of the Faithful) today? And is it compulsory to achieve the condition of Qurashiyyah in Khilaafah?

My question to your excellency is over who is the current Commander of the Faithful, Is it the Mujahid Sheikh  Ayman al- Zawahiri, or is it Mullah Mohammad Omar Mujahid. Or is it that the issue is not yet addressed.

Another point is on the issue of condition of Qurashiyyah in Khilaafah how can it be achieved, especially that the secularists say that the condition of Qurashiyyah can not be achieved therefore Khilaafah can not be achieved.

Are the secularists  and liberals Kuffar generally and individually or not.
Sorry for the sporadic and successive questions because I have been following the pulpit for some time and I did not see that these questions are being addressed.

Praise be to Allah, Lord of the Worlds may Allah bless our Holy Prophet, his family and companions And after:

Q 1) Who is the current Ameerul Mu’mineen (Commander of the Faithful)?

1 c) The Ameerul Mu’mineen is the one whom the Ahlul hal wal aqd (people of the solution and the contract) among the Muslims pledged allegiance to, to judge by the book of Allah Almighty and establish Jihad for the sake of Allah and to listen and obey in hardship and ease, voluntary or involuntary.
And the first to have achieved this pledge today is Mullah Mohammad Omar Mujahid, as for Sheikh Ayman al- Zawahiri, may Allah protect him, he has his oath of allegiance to Mullah Omar.
If the allegiance is made to the Imam Shar’ee (legitimate leader) It is illegal and is not permissible to make it to another man. Due to the hadith of  Abu Sa’eed al Khudri who said: The Messenger of Allah – peace be upon him said:

“If‏ the Bay’ah is made to two Khaleef then kill the second one of them”
[narrated by Muslim]

It is obligatory for all Muslims to engage in this legitimate allegiance and beware of division and discord that occurs because of recidivism from the allegiance of the legitimate imam whom the Muslims pledged allegiance to.
And let them beware of what is threatened by the Prophet, peace and blessings of Allah be upon him in his saying:

«he who separates a hand from obedience, He would meet Allah on the Day of Resurrection without having any evidence and whoever dies and no pledge of allegiance is upon him, died a death of Jaahiliyyah»

[Narrated by Muslim from the hadith of Abdullah ibn Umar]

Q 2) The condition of Qurashiyyah in Khilaafah how can it be achieved, especially that the secularists say that the condition of Qurashiyyah can not be achieved therefore Khilaafah can not be achieved.

A 2) Textual evidences indicate that one of the conditions of legitimacy of the Imam is to be from Quraysh.

The evidences for that are:

1 -his statement, peace be upon him:

«This command is in Quraish no one drags it with them except that Allah throws him in the fire on his face for as long as they uphold the religion»

[narrated by Bukhari from the hadith of Muaawiyah]

2 – his statement, peace be upon him:

“people should always follow Quraysh in this regard (leadership)”

[narrated by Bukhari and Muslim from Abu Hurayrah]

3 – his statement, peace be upon him:

“This matter (leadership) will not leave the midst of Quraish, even if only two of them are left”

[narrated by Bukhari from Ibn ‘Umar]

Al-Hafiz Ibn Hajar commented on this hadeeth:
(what is meant here is not really numbers, but what is meant is reference to selecting a non- Quraish).

4 – his statement, peace be upon him:

«Imams are from Quraysh, they have their rights over you and you have your rights over them. if they are appealed to they accept, when they make covenant they fulfil the term and when they judge they are just, the one who did not do so among them, upon him is the curse of Allah, the angels and all the people»

[Narrated by Ahmad from Anas Ibn Malik]

5 – The words of Abu Bakr, may Allah be pleased with him when the Ansaar gathered under the shed of banu saaidah (… and you know oh Sa’d that the Messenger of Allah – peace be upon him – said while you were sitting:
«Quraish are the custodians of this affair (leadership in Islam) good people will be the subjects of their good ones while bad people would be ruled by their bad ones»
Saad said to him: We are the Ministers while you are the Leaders)

[Narrated by Ahmad in his Musnad]

Al-Nawawi said in Sharh Muslim: (these ahadith and the like are clear evidences that the Khilaafah is restricted to Quraysh and it is not allowed to give allegiance to other than them, and upon this was the consensus held at the time of the companions and taabieen and those after them based on the authentic ahaadeeth).

And there is no point at all in the statements of those who contradict these ahadith among the Mu’tazilis and Ash’aris and contemporary writers.
And if it is possible to achieve this condition, it is obligatory, but when Muslims are unable to achieve this, legitimate leadership is not discarded due to this, rather they should fulfill possible conditions and those that could not be achieved should be left.

The evidences for this are:

1 – Anas bin Maalik, may Allah be pleased with him said:
The messenger of Allah – peace be upon him said-:

“Hear and obey even if an Abysinian slave were appointed over you, whose head is like Zabibah»

[narrated by Bukhari from Anas]

2 – the word of Omar ibn al-Khattab, may Allah be pleased with him: (If death should approach me and Abu Obeida is alive, I will make him the Khaleef and if death should come while Abu Obeida has died, I would make Muadh bin Jabal the Khaleef)

[Narrated by Ahmad with a break in it’s sanad (chain of narration)]

And it is known that Muaadh bin Jabal is an Ansari and not from Quraysh.

These ahadith and it’s like demonstrate the legality of the leadership of a non- Qurashi that could be interpreted to mean cases where it is impossible to get a Qurashi who is fit (meet other conditions) to be the Imaam (Khaleef).

With this we combine between these ahadith and other ahadith that set Qurayshiyyah as a condition, no doubt that the combination between all the evidences is important whenever it is possible as said in Al-Muraaqi:

And combining between the evidences is an obligation when possible … Else…..

Q 3) Are the secularists  and liberals Kuffar generally and individually or not?

A 3) Secularism in reality, is an invitation to a life on the positivist science and reason, and to consider the interest only without religion.

The Oxford Dictionary gives the meaning of the word “Secularism”:

“Secularism is a belief that laws, education, and other regulations, must be based on facts and science rather than religion.”

As for the Encyclopaedia Britanica It has ranked secularism among practical atheism, it defined it as a social movement which aims to distract people from interest in the Hereafter to interest in worldly life alone.

The lexicon defined it as: “other than religious or priestly.” And stated in the modern Arab lexicon: “secular: What is not religious.”
Therefore, many researchers said that secularism means: “atheism.”

And When some of the secularists want to promote secularism and underestimate it’s threat to religion, they say:”secularism” is not hostile to religion, but gives the people the freedom of “religion” in the sense of individual Beliefs, but seeks to banish religion from the areas of real life, and rejects it as a source of rules in the reality of Life!!

Anyone who believes this thought and feels the need to remove the Shareeah from the reality of people and resorting to statutory law, there is no doubt in his Kufr and exit from the religion of Islam.

For this Shaykh al-Islam Ibn Taymiyyah said: “It is known by necessity in the religion of the muslims and by the agreement of all the Muslims that whoever permits the following of  a religion other than Islam, or the following of a law other than the law of Muhammad, peace be upon him, he is a Kaafir”

[Majmoo’ Fataawa 28/524]

As for Liberalism, it goes a further length in Kufr beyond that of Secularism as it seeks for complete freedom and dissociation from all moral and religious restrictions that do not comply with pleasure and benefit, they are said to worship the Desire that Allah said about:

{have you not seen the one who took his desire as his lord?  Would you be a Wakeel for such a person?, Or do you think that most of them hear or understand?, they surely are naught but only like cattle, but they are far more astray}

[Furqan: 43-44].

He also says:

{have you not seen the one who took his desires as his lord and Allah misguided him and sealed his hearing and heart and make his vision blurred, who then would guide him after Allah?, do you not remember?}

[Jaathiyah aayah 23]

Whoever takes these Kufr beliefs as a religion, he is a Kaafir (infidel) outside the fold of Islam.

And Allah knows best Praise be to Allah, Lord of the Worlds.
