Peace be upon you and Allah’s mercy This is the text of what I was told, please answer it
(A Christian came out of his house angry and said to his household: ‘I’ll bring upon you a calamity’ so, he went out and met a Muslim from a noble family, killed him and sought security for himself)

Q: Do we just kill the killer alone?

Q: Is it permissible to transgresss on the Christians of this town since we have the necessary strength and Alhamdulilah for this?

Q: Does he go out of covenant with this murder?

I want the issue to be quickly addressed so as to know our next line of action because the issue is still fresh now, and if delayed the media would start reporting the issue as a sectarian strife, etc. And you know how Egyptian media deals with issues
And I want you to expatiate well on the issue.

Questioner: Ibn Jaanib

In the name of Allah the Merciful Praise be to Allah and peace and blessings on the Holy Prophet and his family and companions.

First: my honourable brother I apologize for not elaborating on the subject due to time constraints and because as I think the issue is clear a little bit and does not require extensive answer.

Second: for as long as you know Oh honourable brother that this Christian did this crime for the purpose of inciting Muslims against Christians, it is not permissible for you to hold them liable for the crime because they did not order it and they did not encourage it and did not defend the actor as I understand from your words.
but you only embark on holding them accountable if they should protect this killer or assist him in his crime.

Almighty Allah has commanded justice in dealing with people, he says:

{do not let the hatred of any people seduce you away from doing justice Be just that is closer to piety}
[Al-Maaidah: aayah 8].

It is unfair to them to hold them responsible for a crime they did not participate in and did not sanction.

Allah the Almighty says:
“no bearer of burdens will bear the burden of another}
[al-An’aam : aayah 164]

As you say: (Does he go out of covenant with this murder?), if what you mean by “Covenant” is being one of the dhimmis, we have stated previously that the dhimmis do not exist now. And that has been treated in more details in a letter: “I’ilaamul ummat bi inqiradi Ahli Dhimmah” meaning “informing the Ummah of the extinction of dhimmis.”
